The creation of an international tribunal for Ukrainian criminals under the auspices of the UN has no prospects, the issue must be worked out with Russia's partners. About this in an interview with Rossiyskaya Gazeta. said the chairman of the Investigative Committee of Russia Alexander Bastrykin.

“Given the position of the collective West, which openly sponsors Ukrainian nationalism and supports the Kyiv regime, the creation of such a tribunal under the auspices of the UN in the current perspective is extremely doubtful. It would be more appropriate to work on this issue with Russian partners in such organizations as the CIS, the CSTO, BRICS, the SCO,— he said.

At the same time, according to him, the establishment of the court and its charter could be formalized by an agreement between Russia and the countries that are members of these organizations, as well as the Donetsk and Luhansk people's republics.

According to Bastrykin, it is also expedient to involve other countries demonstrating an independent position on the Ukrainian issue, based on the norms of international law, in the work on the formation of an international tribunal. Among them, he named Syria, Iran and Bolivia. “The creation of an international judicial body has demonstrated to the entire world community the inevitability of punishment for crimes against the peace and security of mankind, the determination of Russia and the true partners of our country in the eradication of Nazism, nationalism and xenophobia,” — said the head of the Russian Investigative Committee.

In addition, Bastrykin said that the Investigative Committee has already identified more than 220 people, including representatives of the high command of the Armed Forces of Ukraine, involved in the shelling of Donbass. According to him, 92 commanders and their subordinates have been charged. “96 persons were declared wanted, in particular 51 commanders of the Armed Forces of Ukraine”, — he added.

Russia has been conducting a special operation in Ukraine since February 24. Announcing its start, Russian President Vladimir Putin said that the goals of this step are “denazification”; and “demilitarization” Ukraine, as well as the salvation of its inhabitants from the “genocide”.

After the start of the special operation by Russia, Ukraine appealed to the International Court of Justice in The Hague with a lawsuit against Russia. President of Ukraine Volodymyr Zelensky demanded on February 27 that Russia be held accountable for “manipulating the concept of” genocide “; to justify aggression».

In early March, the chief prosecutor of yet another international court— International Criminal Court (ICC),— Karim Khan announced his decision “as soon as possible” start investigating violations on the territory of Ukraine. Press Secretary of the President of Russia Dmitry Peskov then drew attention to the fact that Russia is not a participant in the court and categorically rejects allegations of involvement in war crimes in Ukraine.

Ukraine and Russia signed the Rome Statute in 2000, but did not ratify this document. However, the Ukrainian authorities had previously asked the ICC to initiate proceedings by applying for recognition of the court's jurisdiction over crimes allegedly committed in eastern Ukraine and Crimea, Khan argued. At the end of 2020, the ICC announced the completion of a preliminary investigation into the situation in Donbass.
